Various elements of managing occupational road risk combine to determine whether an organisation is complying with their 'Duty of Care' responsibilities.
Naturally, there is an expectation a Company will fully comply with applicable legislation, including the Health and Safety at Work Act 1974, the Management of Health and Safety at Work Regulations 1992 (updated 1999) and the Provision and Use of Work Equipment Regulations 1998).
In addition to the risk of criminal prosecution, following an incident, both the driver and employer may also be exposed to the threat of a civil action.
The Health and Safety at Work Act 1974 requires employers to ensure, so far as reasonably practical, the health and safety of all employees while at work and that others are not put at risk through their work-related activities (including driving).
The Company On-Line Self Risk Assessment is intended as a guide only. The measures that constitute 'so far as reasonably practical' may vary according to individual circumstances, but considerations will invariably surround the perceived need for controls, relative to the complexity and cost of implementation. A suitable 'weighting' is applied to each question accordingly.
The questions themselves are designed to stimulate thought around issues, but in this format, can only elicit relatively high level information which of course may not be entirely representative of the complete picture. Managers should be mindful too, that the theory is not always matched by the practice.
All questions should be honestly answered in order to receive a meaningful indexed score (to assess and benchmark own performance) as well as a relative performance rating (to assist comparison with other similar vehicle type operations).
